EXCERPT FROM THE MINUTES OF THE 91ST REGULAR SESSION OF THE  14TH SANGGUNIANG PANLUNGSOD, CITY OF GENERAL SANTOS, HELD AT THE SANGGUNIANG PANLUNGSOD SESSION HALL ON THURSDAY, APRIL 6, 2006.

            WHEREAS, it has come to the attention of this Sanggunian that trucks, trailers and heavy equipment or vehicles weighing more than twenty (20) metric tons pass on Lower Silway Bridge at Barangay Dadiangas West, General Santos City;

 

            WHEREAS, the said practice, if remained unregulated, exposes the bridge to danger of being damaged as it could only bear a load not exceeding twenty (20) metric tons;

 

WHEREAS, the passage of trucks, trailers and heavy equipment or vehicles at the said area also aggravated the congestion of vehicular traffic to such a narrow and busy thoroughfare;

 

            NOW, THEREFORE, on motion of City Councilor Eduardo D. Leyson III, for joint sponsorship, duly seconded by City Councilors Lourdes F. Casabuena and Brian G. Estrellan, be it

 

RESOLVED, as it is hereby resolved, to enact this Ordinance:

 

 

ORDINANCE NO. 04

Series of 2006

 

AN ORDINANCE PROHIBITING THE PASSAGE OF TRAILERS, TRUCKS AND OTHER HEAVY EQUIPMENT OR VEHICLES WEIGHING MORE THAN FIFTEEN (15) METRIC TONS AT LOWER SILWAY BRIDGE, IMPOSING PENALTY FOR VIOLATION THEREOF, AND FOR OTHER PURPOSES

            Be it enacted by the Sangguniang Panlungsod of General Santos that:

 

Section 1. The passage of trailers, trucks and other heavy equipment or vehicles weighing more than fifteen (15) metric tons on Lower Silway Bridge, Barangay Dadiangas West, is hereby prohibited.

 

Section 2. Any violation of this Ordinance shall suffer the driver of trailers, trucks and other heavy equipment or vehicles to a fine of P3,000.00 for the first offense, P4,000.00 for the second offense, and  P5,000.00 for the third offense and subsequent offenses.

 

Section 3. If for any reason, any part or parts of this Ordinance shall be held to be unconstitutional, the other part or provision hereof which are not affected thereby shall continue to be in full force and effect.

 

Section 4. This Ordinance shall take effect on the day after ten (10) days following its publication in any newspaper of general circulation within General Santos City.

 

 

Enacted by the Sangguniang Panlungsod, City of General Santos, on its 91st Regular Session held on April 6, 2006.
